CFTC Proposes New Crypto Oversight Rules

Fresh regulations concerning digital asset transactions and markets have been put forward by the U.S. Commodity Futures Trading Commission.

According to a Monday announcement from the agency, these guidelines would permit domestic cryptocurrency exchanges to voluntarily join a federal regulatory framework.

Even though lawmakers stalled the Clarity Act last month, both the CFTC and the Securities and Exchange Commission continue moving forward with independent proposals to govern the digital asset sector.

Chairman Mike Selig stated, “Today’s action is a critical step in the CFTC’s ongoing efforts to ensure America remains the crypto capital of the world.”

He further noted: “The Commission’s announcement begins our process of new rulemakings grounded in the CEA’s purpose and President Trump’s directive to propose a federal crypto asset regulatory market structure using the CFTC’s existing statutory authorities.”

Should they gain approval, the guidelines would enable crypto platforms that provide leveraged trades to register with the agency.

The Clarity Act seeks to formally separate responsibilities between regulators by clarifying which digital assets qualify as commodities, securities, or stablecoins.

However, the legislation encountered roadblocks this year as banking lobbyists raised objections regarding crypto platforms offering stablecoin rewards to users, while several lawmakers—predominantly Democrats—raised ethical concerns about the bill.

Nevertheless, regulators are currently drafting frameworks that the cryptocurrency industry has historically requested.

CFTC Chair Selig, who previously served as chief counsel for the SEC’s Crypto Task Force, mentioned last month that the commission was preparing for markets shifting toward continuous, “24-7, on-chain” operations.

The SEC, which is likewise led by a pro-crypto official, proceeded to greenlight the trading of tokenized stocks in September.

That move followed its August introduction of a dedicated framework for crypto asset offerings, advancing its oversight efforts while major legislation remained deadlocked.

U.S. President Donald Trump made supporting the digital asset sector a key part of his campaign, and following his inauguration, he has approved multiple pro-crypto executive orders and laws.

In August, Trump encouraged lawmakers to finalize the Clarity Act, describing the prospective legislation as “very powerful.”

The preliminary rulemaking notice from the CFTC will remain open for public feedback for a duration of 60 days following its publication in the Federal Register. Subsequently, the commission will evaluate the comments to determine whether to advance a formal proposed rule, which would then undergo another review period prior to the adoption of any final regulation.
